American with Disabilities Act (ADA) Equal Access Legislation
The American with Disabilities Act (ADA)
Signed in to law on June 26, 1990, the Americans with Disabilities Act, ADA, is a law which prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against individuals with disabilities. The law is divided into five sections or titles:
- Title I – Employment: Business must provide reasonable accommodations to protect rights of individuals with disabilities in all aspects of employment.
- Title II – Public Services: Public services, which include state and local government and other public entities, cannot deny services to people with disabilities participation in programs or activities which are available to persons without disabilities.
- Title III – Public Accommodations – All new construction and modifications must be accessible to individuals with disabilities.
- Title IV – Telecommunications – Telecommunications companies offering telecommunications services must accessible service for persons with disabilities
- Title V – Miscellaneous – Includes a provision to prohibit either coercing or retaliation against disabled or those attempting to aid people with disabilities.
The ADA and the titles found therein is wide-ranging legislation intended to make society more accessible to persons with disabilities.
Title II of the ADA
Title II of the ADA applies to State and Local governments. This includes all departments of government including towns and townships, water district, school districts, special purpose districts. Title II prohibits discrimination on the basis of disability in all services, activities and program provided by governmental entities. As such, all persons must have an equal opportunity to benefit from and participate in all governmental services. To ensure that equal participation, the ADA has set requirements for town facilities, new construction, and procedures to provide for access to governmental services and activities.
